Terms of Service.

Who can join.

You must be at least 18 years old to apply to either program. If you're under 18 your application will be denied and any account, discount code, or commission tied to you will be revoked.

You must own or have the right to use the social accounts you list on your application (Instagram, TikTok, Discord, or any other). Buying followers, engagement, or accounts you don't actually control is grounds for removal at any time.

The program is currently open worldwide, but shipping availability, payout methods, and discount pricing may be limited by country. We reserve the right to accept or reject any applicant for any reason.

The Creator track.

If accepted as a Pholoh Creator, we may ship you product at no cost so you can shoot content with it. Approval is not a guarantee that any specific product will be sent — final shipments are at our discretion based on fit, stock, and campaign needs.

Product

• Product we ship you is yours to keep unless we tell you otherwise in writing at the time of shipment.
• You are responsible for any duties, taxes, or customs fees on items shipped internationally.
• If a shipment is lost or arrives damaged, tell us within 14 days and we'll make it right.

Content

• By posting content featuring Pholoh product, you grant Pholoh a worldwide, royalty-free, non-exclusive license to repost, reshare, and use that content on our owned channels (site, email, paid ads, retail displays) in perpetuity, with credit to your handle where feasible.
• You keep ownership of your content. This license does not transfer copyright.
• You agree to disclose the partnership as required by law in your country (e.g. FTC rules in the US, ASA in the UK). #ad, #pholohpartner, or the platform's built-in "paid partnership" tag all work.

Codes & commission

• Approved Creators receive a personal discount code. Every completed, non-refunded order that uses your code pays out commission at the rate stated in your welcome email.
• Payouts land monthly for any balance over $50 USD. Balances under $50 roll to the next month.
• Fraudulent orders (self-orders, chargebacks, refunded orders) do not earn commission and may be clawed back.

The Ambassador track.

Ambassadors buy Pholoh at a discounted rate, complete the 3-day content challenge, and earn commission on sales driven by their code.

Pricing

• Approved Ambassadors unlock 25% off one item (Solo Kit) or 35% off two or more items (Full Fit) through their private ambassador page.
• Ambassador pricing is for personal use only. Reselling Pholoh product bought at ambassador pricing is not allowed and will result in removal from the program and reversal of any outstanding commission.
• Discounts don't stack with other sitewide promotions unless we say so.

The 3-day challenge

• Post one fit video per day for three consecutive days on your primary platform (Instagram or TikTok).
• Each post must tag @pholoh and be public for at least 30 days.
• Completing the challenge unlocks your personal ambassador discount code and commission tier.

Commission

• Commission on completed, non-refunded orders driven by your code is paid monthly for balances over $50 USD.
• All the fraud, chargeback, and clawback rules from Section 02 apply here as well.

How you show up.

As long as you're in the program, you agree not to:

• Post anything that's hateful, harassing, sexually explicit involving minors, or otherwise illegal.
• Trash competitors by name in content that also features Pholoh product.
• Publicly disclose confidential info we share with you (unreleased product, unreleased pricing, campaign plans, internal payout rates).
• Misrepresent yourself as a Pholoh employee, spokesperson, or officially sponsored partner beyond the scope of the program.

Violations can result in immediate removal, revocation of your discount code, and forfeiture of any unpaid commission balance.

What we do with your info.

We collect the info on your application (name, email, socials, DOB, country, shipping address if applicable, Discord handle) to run the program: review applications, ship product, pay commission, and communicate with you. We don't sell it.

We use standard third-party tools to operate — email delivery, payment processors, hosting, analytics. Those providers see only what they need to perform their job.

You can request deletion of your data at any time by emailing info@pholoh.com. If you have an outstanding commission balance or open orders, we may retain the minimum info needed to close those out.

Ending the deal.

Either side can end the relationship at any time, for any reason, with written notice (email counts). On termination:

• Your discount code stops working.
• Any commission earned before the termination date, and above the payout threshold, will be paid on the next scheduled payout.
• The content license from Section 02 survives termination — content you already posted stays licensed to us under the same terms.

Updates to these terms.

We may update these terms as the programs evolve. If we make a material change (payout rate, discount structure, content rights) we'll email you at the address on file. Continuing to participate after an update means you accept the updated terms.

The fine print.

The programs are provided as-is. To the maximum extent permitted by law, Pholoh is not liable for indirect, incidental, or consequential damages arising from your participation. Nothing in these terms limits liability that can't be limited under applicable law.

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Los Angeles County, California.
